Terms of service

These legal terms apply to consumers as well as to commercial end users who purchase Krützberg products for their own use. Orders for resale, dealer orders or wholesale transactions are not subject to these shop terms and are handled exclusively under individual agreements.

1. General Terms and Conditions (GTC)

1.1 Contracting party and scope

The following General Terms and Conditions apply to all orders placed through the Krützberg online shop by consumers as well as by entrepreneurs who purchase Krützberg products as end users.

A consumer within the meaning of these GTC is any natural person who enters into a contract for purposes that are predominantly outside their trade, business or profession.

An entrepreneur within the meaning of these GTC is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of their trade, business or profession.

The online shop is aimed at end users of the products. This includes consumers as well as commercial users, in particular photographers who use Krützberg products themselves in their work.

Orders for resale, dealer orders, wholesale transactions or other reseller transactions are not subject to these shop terms. Such transactions are carried out exclusively on the basis of individual agreements.

Conflicting terms, or terms deviating from these GTC, are not recognised unless Krützberg has expressly agreed to their application in writing.

1.2 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order.

You can first place products in the shopping cart without obligation. In the cart you can review, change or remove your entries at any time.

During the order process you enter your delivery and payment details and review the summary of your order.

By clicking the final order button (for example, order with obligation to pay), you submit a binding offer to conclude a purchase contract.

After submitting your order, you automatically receive a confirmation by e-mail. This confirmation documents receipt of your order. The purchase contract is concluded once we expressly accept your order or dispatch the goods to you.

The contract language is German.

1.3 Storage of the contract text

After completing your order, you receive an e-mail with the essential order data. You can access the currently valid version of the GTC on our website at any time.

1.4 Prices and value added tax

All prices stated in the online shop are in euros and include the applicable statutory value added tax, where this applies.

VAT is shown separately on the invoice where this is legally required.

1.5 Payment

The available payment methods are shown during the order process. These may include in particular:

credit card via Shopify Payments, for example Visa, Mastercard, American Express or Maestro,

PayPal,

Apple Pay,

Google Pay,

Shop Pay,

further payment methods provided via Shopify Payments.

The payment methods actually available may vary depending on country, device, browser, payment provider and technical availability.

Discounts for early payment are not granted.

1.6 Delivery and shipping

We ship with DHL or a comparable shipping service provider.

Shipping to parcel lockers and post office branches is possible, provided that all required details, in particular the Post ID and correct address, are entered during the order process.

Unless stated otherwise for the respective product, delivery within Germany usually takes 2 to 5 working days after receipt of payment.

The applicable shipping costs are shown during the order process before the order is completed. The amount depends on the delivery country, shipping method and order volume.

We only ship to the countries and regions selectable in the checkout. Shipping to the USA, South America and Asia is currently not offered.

1.7 Retention of title

The goods remain the property of Krützberg until the purchase price, including all ancillary claims, has been paid in full.

1.8 Statutory liability for defects

The statutory rights regarding liability for defects apply.

Please inspect the goods upon receipt. You are welcome to report obvious transport damage or recognisable defects to us promptly so that we can review the matter quickly. Your statutory rights are not restricted if you do not make such a report, or do not make it immediately.

For entrepreneurs, the statutory duties to inspect the goods and to give notice of defects apply additionally, insofar as these are applicable in the individual case.

1.9 Voluntary 3-year guarantee

In addition to the statutory rights regarding liability for defects, Krützberg grants a voluntary guarantee of 3 years from the invoice date against material and workmanship defects. The full guarantee conditions can be found in Section 5 of these legal terms.

1.10 Krützberg product protection scheme for the Zeithalter line

For products of the Zeithalter line, there is additionally a product protection scheme. It concerns coverage in the event of proven material or workmanship defects, and products that are designed for a load capacity of up to 5 kg. The full conditions can be found in Section 6 of these legal terms.

1.11 Natural material: leather

Krützberg products may be made from natural materials. Leather in particular may differ in colour, grain, structure, surface, edge appearance and patina from product photos or from other items. These natural differences do not constitute a defect, but reflect the material properties and individuality of the leather used.

1.12 Usage notice for camera carrying systems

Before each use, the user must check, on their own responsibility, that the product is properly attached to the camera, lens and accessories.

In particular, attachment points, rings, screw connections, adapters and other connecting elements must be checked regularly for firm seating, wear and damage.

The stated load capacity must not be exceeded. The equipment may only be used at suitable and intact attachment points.

Responsibility for the proper attachment and use of the equipment lies with the user.

1.13 Liability

Krützberg is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health.

In the event of a slightly negligent breach of material contractual obligations, Krützberg is liable only for the foreseeable damage typical for the contract. Material contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.

Otherwise, liability for slight negligence is excluded to the extent permitted by law.

Liability under the Product Liability Act (Produkthaftungsgesetz), as well as claims arising from an assumed guarantee or from the Krützberg product protection scheme, remain unaffected.

1.14 Right of withdrawal and voluntary return right for commercial end users

Consumers have a statutory right of withdrawal in accordance with our instructions on withdrawal (see the Return and Withdrawal Policy).

Entrepreneurs are not entitled to a statutory right of withdrawal. However, Krützberg voluntarily grants commercial end users a contractual return right of 30 days, provided that they purchase Krützberg products for their own use and not for resale.

This voluntary return right for commercial end users applies under the same periods and conditions as described for consumers in our instructions on withdrawal (Return and Withdrawal Policy), unless expressly stated otherwise there.

Statutory rights regarding liability for defects remain unaffected.

1.15 Exclusion or expiry of the right of withdrawal

The right of withdrawal does not exist in the cases excluded by law.

Krützberg currently offers, in principle, ready-configured products in the online shop. Provisions on individually manufactured or personalised products are therefore currently not relevant for Krützberg.

1.16 Electronic communication

You agree that contract-related communication may take place in electronic form, to the extent legally permissible.

1.17 Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

1.18 Data protection

Information on the processing of your personal data can be found in our Privacy Policy.

1.19 Final provisions

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.

5. Guarantee conditions

5.1 Guarantor

5.2 Duration and scope

Krützberg grants a voluntary guarantee of 3 years from the invoice date.

The guarantee applies worldwide to the first purchaser of the product.

The guarantee applies to consumers as well as to commercial end users who purchase the product for their own use.

A suitable proof of purchase is required in order to claim under the guarantee.

5.3 Content of the guarantee

The guarantee relates exclusively to material and workmanship defects of the Krützberg product.

In a justified guarantee case, Krützberg may, after reasonable examination, offer in particular a repair, a replacement or another appropriate solution.

5.4 Not covered by the guarantee

Not covered by the guarantee are, in particular:

normal wear,

usual signs of use,

leather patina,

colour changes due to use, light, moisture or ageing,

scratches and signs of use,

damage due to improper use,

damage due to missing or incorrect checking of the attachment,

damage due to unsuitable camera or accessory attachment points,

damage due to unauthorised modifications, repairs or alterations,

damage due to external influences, accidents or falls.

5.5 Claiming under the guarantee

To claim under the guarantee, please contact us by e-mail at info@kruetzberg.de.

Please include, where possible:

order number or invoice,

photos of the product,

photos of the suspected defect,

a brief description of the problem.

Please only return products after prior agreement.

5.6 Relationship to statutory rights

This guarantee exists in addition to your statutory rights.

The statutory rights regarding liability for defects are not restricted by the guarantee.

6. Product protection scheme for the Zeithalter line

6.1 Scope of application

The Krützberg product protection scheme applies to products of the Zeithalter line and is open to end users – private and commercial.

All products of the Zeithalter line are designed for a load capacity of up to 5 kg and are covered under the product protection scheme.

The product protection scheme applies exclusively to products purchased for own use. Dealer, reseller or wholesale transactions are not covered by this scheme, unless expressly agreed otherwise.

6.2 Requirement

The product protection scheme applies exclusively in the case of proven material or workmanship defects of the respective Krützberg product.

A precondition is that the damage to the equipment carried was caused by such a material or workmanship defect.

6.3 Damage assessment

A claim is forwarded by Krützberg to the responsible insurer, currently Gothaer, for review.

The decision on compensation is made after review by the responsible insurer, currently Gothaer.

Krützberg is not itself an insurer and does not owe any insurance benefit of its own.

The product protection scheme does not establish any direct insurance contract between the customer and the insurer.

6.4 Obligations in the event of damage

In the event of damage, you must document the incident immediately and report it to Krützberg immediately.

Please contact us at info@kruetzberg.de and include, where possible, the following information:

order number or invoice of the Krützberg product,

a precise description of how the damage occurred,

photos or videos of the damaged equipment,

photos or videos of the Krützberg product,

photos of the attachment situation,

proof of purchase or value of the damaged equipment, where available,

further evidence, where required for the assessment.

The affected Krützberg product must be kept and made available for inspection on request.

6.5 Exclusions

Not covered are, in particular, damages caused by:

improper use,

exceeding the intended load capacity of 5 kg,

failure to check the attachment before use,

incorrect or unsuitable attachment,

damaged camera, lens or accessory attachment points,

unauthorised modifications or repairs to the product,

external influences, accidents or falls not attributable to a material or workmanship defect of the Krützberg product,

intentionally or grossly negligently caused damage.

6.6 No deductible

Krützberg does not charge a deductible under this product protection scheme.

6.7 No own insurance contract

The product protection scheme does not establish any direct insurance contract between you and the insurer.
